NOTICE FROM THE CLERK NO. 23-01

HOURLY RATES AND CASE MAXIMUM INCREASES FOR CRIMINAL JUSTICE ACT (CJA) PANEL ATTORNEYS

 

Pursuant to an Executive Order issued by President Joseph Biden on December 2022, inflationary adjustments were made to the hourly rates and case compensation maximums under the Criminal Justice Act (CJA), 18 U.S.C. §3006A, as follows.

 

Effective January 1, 2023, the panel attorney hourly rates increased from $158 to $164 for non-capital work and from $202 to $210 for capital work. These new hourly rates apply to services performed on or after January 1, 2023. Where the appointment of counsel occurred before January 1, 2023, the new hourly compensation rate applies to that portion of services provided on or after the effective date.

 

The non-capital rate increase will result in increases to the panel attorney case compensation maximums in non-capital cases. The adjusted panel attorney case compensation maximums are now as follows:

The case compensation maximum for investigative, expert, or other services without prior authorization remains at $900.00. The case compensation maximum amount with prior authorization increased from $2,700.00 to $2,800.00. This maximum amount, which excludes expenses, applies to each individual service provider in non-capital representations.

The new case compensation maximums apply to a voucher submitted by the appointed counsel or expert if that person furnished any CIA-compensable work on or after January 1, 2023. The former case compensation maximums apply to a voucher submitted by the appointed counsel or expert if that person's CIA-compensable work on the representation was completed before January 1, 2023.

 

The new hourly rates and case compensation maximums were updated in eVoucher through a national update.
